I have several people I know that have been detained, or in some cases even arrested and when they had a body search done their knives or guns were taken from them. In one circumstance my friend had a concealed handgun license and legally owned his gun. Once he was let go and charges dropped, he could never get his gun back from the police department. As was the case with other people I know that had a very difficult time getting their weapons that were legal weapons back. Why is this? Is this legal?? I am a little confused by this. Maybe someone can enlighten me about how this works and why it is so difficult and almost impossible in some cases to get your things back.

Well your friends could consider themselves lucky, if they had "illegal" weapons and the cops took them away and didn't arrest them. On the other hand if the officers were taking away "legal" weapons and keeping them for themselves, well then your friends got unlucky and had property stolen from the largest gang of street thugs in America! If the police take property from a person, that person should request a "receipt" for that property taken by the officer. Be careful how you ask for a receipt, because you might end up mugged and beaten. Your friends could always file a complaint against the officer for taking their property and that they have failed to return it. They could also file "theft" charges against the officer, but for this I would let an attorney handle that. They will even break the law when told to do so. An example of this would be the New Orleans police going door to door and confiscation guns, after the hurricane. These same officers that swore to up hold the U.S. Constitution, were willing to break the law just because a "superior" told them to do so and no questions ask. Now those people who had their guns stolen at gun point by the police, are also having trouble getting their weapons back from the government. we had a search warrant served on us seven months ago. The police confiscated over $10,000 worth of items from us. this includes a very expensive gun collection. We were not given any list or serial numbers from any of the guns confiscated. These guns were not stolen or used in any crime. THese were guns we have owned over 20 years. We have not been charged with any crime, yet the police will not return our posessions. Or give us a list of the guns that were confiscated. They have now served us with a total of 3 search warrants over the past 7 months no charges and no crime, just harrassment on a bi-racial business couple. Welcome to Lawrence Kansas!
