06.15.2006- A former police officer who lost his job after he sold his service weapon for cocaine is back in jail.
Emerson L. Brown II, 39, of Locust Grove was arrested Sunday on a probation violation, court records show. He is being held in the Rappahannock Regional Jail without bond.
According to paperwork filed in Fredericksburg Circuit Court, Brown's probation officer claims he failed to complete the 200 hours of community service he was ordered to. Court records don't elaborate on Brown's alleged infraction.
Brown is scheduled to have video conference with a judge from the jail tomorrow, at which time a date for his next hearing will be set.
Brown had been with the Gordonsville Police Department for just over a year when he failed to show up for work in October 2003.
A search and investigation revealed that he had been on a crack cocaine binge in the Mayfield area of Fredericksburg for several days.
During the three-day binge, Brown sold his police-issued .40-caliber Glock pistol for $200. He used that money to buy more crack, according to evidence presented at his trial.
Brown, who had worked as an undercover narcotics officer, initially told police he'd been abducted and taken to Fredericksburg. He later admitted what had really happened.
Brown pleaded guilty in August 2004 to embezzlement and filing a false police report. Four other charges were dropped.
Judge John W. Scott Jr. sentenced Brown to a total of five years and six months in prison-with all but six months suspended. Brown had already served 62 days at the time.
Defense attorney Mark Crossland said at the sentencing that Brown had learned his lesson and told Scott "you will never see him [in court] again."
