May 07, 2006 - A San Antonio police officer facing a state marijuana-possession charge is now looking at up to life in prison after he was indicted on charges alleging he let his girlfriend and other people traffic methamphetamine out of his home.
In a hearing today, U.S. Magistrate Judge Nancy Nowak ordered Joseph Anthony Evans, 42, held without bond pending a bail hearing on May 22.
Court records show Evans was arrested on the marijuana charges in February after his live-in girlfriend, Katherine Stacy Sanchez, 32, was allegedly caught with methamphetamine.
As Evans’ marijuana case ran through the state system, a federal grand jury on Tuesday indicted Evans and three other people, whose identities remain sealed. Evans was charged with conspiracy to distribute and posses with intent to distribute more than 50 grams of methamphetamine; aiding and abetting others in the possession and distribution of methamphetamine; and maintaining drug-involved premises. The conspiracy charge carries a penalty of 10 years to life in prison, while the other two are punishable by up to 20 years.
“He maintains his innocence, and we look forward to trial,” said attorney Ben M. Sifuentes Jr., who with lawyer Eddie Garcia, represents Evans in the state matter. Sifuentes appeared with Evans at his initial hearing in federal court, but told Nowak that he and Garcia have not yet been retained for the federal case.
Sanchez was indicted federally in April a charge of possession with intent to distribute methamphetamine. She was released on unsecured bond, records show.
San Antonio police narcotics detectives concentrated on Evans’ home in February after getting information that Sanchez was selling large amounts of methamphetamine out of that house, court records show.
She was arrested after leaving the home in a Cadillac Escalade and officers found methamphetamine in the vehicle, records show. Evans consented to a search of his home and police found a small amount of cocaine, methamphetamine, drug paraphernalia and less than 2 ounces of marijuana.
Evans had been on administrative duty after the February arrest. San Antonio police narcotics detectives arrested him at work Tuesday on a warrant issued with the federal indictment.
The department has since placed Evans on temporary suspension, a police spokesman said.
