01.17.2007 - Officer David Eugene McBryant, a former Clarksville Police officer who was charged in September with indecent exposure, will avoid jail time if he can meet probation for the next few months. McBryant was accused of exposing himself to a 22-year-old female convenience store clerk on Dec. 4, 2005. He'll be on a pretrial diversion, which is a probationary period during which time the case doesn't go to trial and charges are dismissed if the defendant meets conditions set by the court. The diversion is for 11 months and 29 days. McBryant's agreement set the beginning of the probationary period at April 2006, so it is set to end in April. According to a police report, McBryant was speaking casually with the clerk while off duty and in civilian clothes. McBryant pulled down his sweatpants and exposed himself to the clerk, who told him the business was under video surveillance, according to police. McBryant was charged Dec. 7, 2005, and resigned from the Police Department four days later. He'd served on the force for 10 years. After successfully completing probation, McBryant can request that the charge be expunged from court records. The pretrial diversion was signed on Jan. 11.
