August 28, 2006 - The trial of Aberdeen part-time police officer Clark Gast has been set for Oct. 30, in the Brown County Court of Common Pleas, however, a motion by the defense to dismiss charges is still pending.
No decision was made at an Aug. 17 hearing in front of Common Pleas Judge Alan Corbin on a motion by Gast's defense council requesting charges be dismissed.
"The motion is basically under advisement, but pending a decision," said Corbin.
According to Corbin, both the prosecution and Gast's defense attorney John B. Caldwell wished to file brief statements in regard to the motion to dismiss. Corbin said a decision on Gast's motion to dismiss should be made prior to the final pretrial scheduled Oct. 6, just two weeks prior to the date Gast's jury trial is slated to begin.
Gast, Aberdeen Police Sergeant Gary P. Hafer Jr., and Aberdeen Police Chief Gary P. Hafer Sr., following a five-month investigation by the Ohio Bureau of Criminal Identification and Investigation, were indicted on April 3, in the Brown County Court of Common Pleas on felony charges.
Gary Hafer Jr. was indicted on two counts of gross sexual imposition, two counts of rape, burglary and theft in office.
Gast was charged with aiding or abetting Gary Hafer Jr. to engage in sexual contact by use of force or threat with one of the three victims listed in Gary Hafer Jr.'s case file.
Gast has also been charged with a misdemeanor for failure to report a felony crime, a fifth degree felony for theft in office and dereliction of duty as a police officer for negligently failing to prevent or halt the commission of an offense or to apprehend an offender, charges from incidents that allegedly occurred in May and October of last year.
Aberdeen Police Chief Gary P. Hafer Sr. was indicted for complicity to theft in office for allegedly aiding or abetting Gary Hafer Jr. in committing offenses involving theft in office that took place from February 2004 through Oct. 31, 2005, a fifth degree felony.
Gary Hafer Sr. was also indicted for dereliction of duty for being a law enforcement officer and negligently failing, preventing or halting the commission of an offense or to apprehend an offender, a second degree misdemeanor.
A pretrial hearing for Gary Hafer Sr. has been set for Oct. 2 at 8:30 a.m. in the Brown County Court of Common Pleas.
A jury trial has yet to be scheduled for Gary Hafer Jr.
