06.28.2006 - TAMPA - A Tampa police officer charged with stalking his former girlfriend, a former Hillsborough County prosecutor, will serve a year on probation.
As part of the plea agreement, James Cabble, 35, agreed to return a personal DVD the couple made when they were dating. He signed a sworn statement saying he made no copies.
In accepting the plea for the misdemeanor stalking charge, Pinellas County Judge Paul Levine withheld a finding of guilt. If Cabble completes probation successfully, he will not have a criminal conviction on his record.
Cabble and Danicet Cura began dating in December 2003 after both had divorced their spouses. He was with the police department's Tactical Response Team, and she was an assistant state attorney who handled armed robbery and drug cases.
A year later, the two broke up.
According to court records, Cura claimed that Cabble began to call her as many as 200 times a day and threatened to plant drugs on her brother. Cura said Cabble also threatened to hand out copies of the DVD.
Cabble was removed from his position on the tactical squad and placed on a desk job pending the outcome of an internal investigation.
The internal investigation has been on hold pending the outcome of the court case, said police spokeswoman Laura McElroy. Now that the court proceedings are over, the investigation will continue, she said.
Cura left the Hillsborough County State Attorney's Office for a private law firm in 2005. The state attorney's office and a local judge recused themselves from the case to avoid perceived conflicts.
Pinellas County prosecutor Doug Ellis said Cabble also will have to submit to a mental health evaluation and treatment if warranted. He may have no contact with Cura.
