August 06, 2006 - 08/03/2006 OCEAN CITY – A New Jersey police officer that allegedly coerced a 15-year-old female juvenile into performing fellatio on him last weekend was arrested at a downtown beach.
Resort police arrested and charged Officer Cesar Manuel Moyano, 25, of North Arlington, N.J., with an open container violation, perverted practice and third- and fourth-degree sex offense last Saturday when a routine check of the beach led to a highly graphic and disturbing image.
Officer Moyano, reportedly a Bergen County sheriff officer, was lying down on the 22nd Street beach approximately 25 feet from the Boardwalk when police made the discovery.
At around 5:30 a.m., Ocean City Police Department (OCPD) Officer Earl Campbell was patrolling the beach near 28th Street when he spoke with a couple that pointed to Moyano and the female juvenile, who appeared to be engaged in sexual activity, according to court documents.
The officer approached the couple, when it became clear that the 15-year-old female was performing oral sex on Moyano. According to court documents, a handful of witnesses were in the area and the couple was within eyeshot of the Boardwalk. Campbell then interrupted the sex act and was immediately drawn to the girl’s youthful features, according to police. As the officer began speaking with the couple, he also noticed an open beer bottle and a closed bottle of Jagermeister alcohol in front of them on the beach.
While speaking with Officer Moyano and the female juvenile, Campbell was able to determine that the girl was only 15-years-old. According to court documents, Moyano told police he believed she was 20. The girl then reportedly became angry and said Moyano told her it would be acceptable to engage in sex acts with him because he was a deputy sheriff. Moyano confirmed that he was a New Jersey law enforcement official.
Campbell then separated the couple and spoke with the female who said she had met Moyano earlier that night and he was allegedly helping her find a friend. As the night wore on, however, the victim said he asked her to “go out on the beach and fool around,” according to court documents. The 15-year-old female told police she was reluctant and hesitant, but went out to the beach with Moyano anyway. As the couple became intimate she allegedly “said no several times, but in the end gave in.”
The girl continued to tell the officer that she felt pressured into the situation, but was not physically injured. After speaking with the victim, Campbell approached Moyano, who said he was wrong for drinking alcohol on the beach, but believed the female was 20 years old. Moyano was then placed under arrest for an open container violation, perverted practice, and third- and fourth-degree sex offense.
Moyano has since been released on $15,000 bond and awaits possible disciplinary action in New Jersey pending the outcome of the charges, sources say.
It would not be the first time a New Jersey law enforcer was arrested during the summer in Ocean City. Last year, local police arrested David Scott Salardino, 33, of Edison, N.J, for indecent exposure when he reportedly stood in front of his 112th Street hotel room window and continued to expose himself to passerby. Salardino, a member of the Edison police force, allegedly banged on the window to get people’s attention, then attempted to show off by flexing his muscles naked, according to police.
