August 07, 2006 - .S. Capitol Police Sgt. Michael Malloy is out of jail tonight. A judge released him on bond.
Last week authorities revealed that for nearly a year, a Bowie High School coach pimped the girl to Malloy and other men all over the area.
Malloy is learning what it's like to be on the other side of the law.
"He's handling it as best as he can. This is a stressful situation for my client but he's a strong man and is handling it the best he can," says Malloy’s lawyer.
The fifteen year police veteran with a previously clean record is fighting to stay out of jail.
Authorities say the trouble began last year when his longtime friend, Bowie high school coach Arron Burroughs, introduced him to the victim, a prostitute just 15 years old. The girl says her pimp told her, "The guy is cool. He's a police officer."
Authorities say the first encounter with the 15-year old happened last fall in a parking lot near 2nd and D-streets. The defendant allegedly received oral sex in the back seat of a car.
While Malloy denied that the encounter ever took place, he couldn't deny what happened next because it was caught on videotape. Twice, over several months, Burroughs brought the girl to Malloy’s Charles County home where police say the two men taped themselves having sex with the teen. Police now have that tape as evidence.
Malloy allegedly paid Burroughs 40 to 50 dollars for the encounters. The girl told police she tried to get him to pay 200 dollars but he refused, saying he thought it was just a "hook-up".
Last week, the relationship was revealed after police found the girl servicing another client in Takoma Park. They later arrested Burroughs, who remains in jail without bond. He's accused of pimping her to men all over the metro area for nearly a year.
Meanwhile, the key question for Sgt. Malloy may be whether he knew the girl’s true age. Under questioning by investigators, he said he "thought she was a student at Bowie State, but admitted she did look young." Prosecutors say ignorance of age is not a legal defense.
The judge placed Sgt. Malloy under an electronic monitoring system and he'll be confined to his home every night. He's also not allowed to have contact with anyone under the age of 16.
Malloy remains on-leave without pay from the Capitol Police force pending the outcome of an investigation.
