06.02.2006 - An Atlanta police officer is being investigated this afternoon for possibly lying under oath about an arrest. The case involves an Atlanta businessman who says he was brutalized by the officer.
Richard Holmes is a former cop, now a private investigator, who claims he was brutalized by an Atlanta cop.
A security video shows the incident happened in January, as Holmes was in his car, trying to leave the parking lot at a downtown office building, where he had an office.
Holmes says he had a brief dispute with the parking lot attendant, which was resolved. But as he was beginning to drive away, Atlanta Police Officer N. Dimauro walked up, pulled Holmes out of his vehicle and arrested him for aggravated assault and DUI.
In his report, and in sworn testimony to a grand jury, the Dimauro said that Holmes struck him with his car, dragged him and pinned him against the parking lot booth. The charges were dropped when the security video showed otherwise.
But dropping the charges is not enough for Holmes. He and his attorney are asking for a formal apology from the city of Atlanta. They also want Officer Dimauro -- who apparently lied and jailed him -- to be fired and prosecuted himself.
No comment has come from the officer, or from officials with the Atlanta Police Department.
