03/23/2006 - CORPUS CHRISTI, TEXAS - A federal jury clears three Corpus Christi police officers of brutality charges. Blake and Tiffany Avalos - a Corpus Christi brother and sister - sued the city, claiming the officers used excessive force when they were arrested outside a downtown nightclub last April.
The jury said Tiffany's arrest was lawful. They also decided officers did not use excess force when arresting Tiffany and her brother Blake. A big shock to the Avalos attorney.
Tiffany's attorney said the pictures tell it all. He said the injuries are a clear sign of police brutality. Christopher Gale can't understand why a jury didn't agree.
"I don't know. I'm kind of at a loss for words as to what in the case detracted them from the truth. We're very dismayed with the verdict," Gale said.
Tiffany and Blake left the courtroom without a comment, but the city's attorneys said Tiffany's injuries were caused by accident. They believe officers did not violate her constitutional rights and she in fact fell to the ground by accident. Even with the jury's decision, Gale hopes it doesn't have a negative effect on future complaints.
"If no one complains about officers who over step their boundaries, then no one will ever know and nothing will ever change in this community."
Tiffany and Blakes attorney said they do have the option to appeal Wednesday's decision. He said they're still considering going that route.
