07.28.2006 - 7/28/06 - ROSENBERG, TX - A woman showed Eyewitness News how she says a Rosenberg police officer assaulted her. And she had her home video camera rolling the whole time.
Ever since Geneva Flora got her video camera for Christmas two years ago, she's filled lots of tape.
"I pick it up for police activities, parades, car wrecks, my dogs playing," she said.
So on Monday night when police were called to a shooting next door, Geneva got her camera. There were at least three officers on the scene, but only one, Officer David Evans, seemed agitated by her presence. He repeatedly shined his flashlight at her lens and then did this...
Officer Evans acted like he hadn't see Geneva, but just seconds earlier, he had asked her a question and once again shined his flashlight in her face.
"He puts the flashlight and comes by and where this guy is, takes his elbow and 'Bam,'" said Geneva.
Geneva calls it assault.
"I felt I was done wrong," she said. "I was on my own property. I wasn't in the way of their investigation and he asked me a question and I gave him an answer and I didn't say another word.
The next day, she took a trip to the Rosenberg Police Department, filed a complaint and showed Lieutenant Colin Davidson the video.
"It's conduct that we will not tolerate in any way, shape or form," he said.
He tells us Officer Evans was fired for using unnecessary force. Geneva is satisfied.
"If this man would hit me with a camera on him, what would he do when the camera's off?"
Evans, who has been with the Rosenberg Police Department for two years, has the right to appeal his termination. We're told he has done so and a hearing will be set over the next couple of days . We tried to find Evans for comment, but were unsuccessful.
