06.15.2006 - Before he was arrested in Derry, a Windham police officer was placed into custody in Plaistow on Sunday night after police responded to a report of a domestic disturbance, police said yesterday.
Two police officers responded around 8:55 p.m. after a reported disturbance involving Stephen Moltenbrey, 44, of Derry at a Plaistow home where his wife was a guest. The officer was not charged, police said, but he was taken into protective custody because authorities believed he was intoxicated.
His wife, Donna Moltenbrey, applied for an emergency restraining order that night through the police department, said Plaistow Police Sgt. Thomas Hawthorne. Stephen Moltenbrey was taken home by his brother, Hawthorne said.
“There has to be some reason that somebody is in fear, specifically in that small time frame,” Hawthorne said of obtaining an emergency restraining order. “It would only be good until sometime the next day, enough time for them to go and get a real restraining order.”
Shortly after being served with the order, Moltenbrey allegedly violated it by calling his wife while in custody at the Derry police station, according to court documents in Derry District Court. His wife called the police station at 1:30 a.m., saying she had just gotten a call from her husband’s cell phone, according to court papers.
She recognized the number, she told police, and didn’t answer. She told police the call was placed at 1:27 a.m. Moltenbrey had been allowed to use his cell phone while in custody to try to get a ride home, according to court papers.
He was held overnight before his arraignment Monday in the Derry court, as is required by law when anyone is charged with violating an emergency restraining order.
Moltenbrey is free on $2,000 cash bail, pending his trial next week. One of his bail conditions is that he cannot carry a gun. He is on paid leave at the Windham Police Department; officials there opened an internal investigation into the incident Monday.
