June 14, 2006 - A third woman has sued former Austin police officer Jason Lockaby and the City of Austin, claiming that Lockaby fondled her during a traffic stop and took her to jail when she resisted his advances.
Officer Lockaby, 35, has now been sued by all three women whose allegations led to his firing in December 2004 and criminal conviction in October. The other two women sued Lockaby separately in March and in May 2005; those lawsuits are pending.
Officer Lockaby could not be reached Tuesday for comment. He was convicted of improper sexual activity with a person in custody, attempted improper sexual activity with a person in custody and official oppression.
He was sentenced to three months in county jail for touching the breasts of two women and pressuring a third to show him her breasts to avoid arrest. He also was fined $1,000, was required to forfeit his Texas peace officer's license and was given five years deferred adjudication, a form of probation.
The newest lawsuit was filed Thursday by a woman referred to as "Jane Doe III." She claims that Lockaby stopped her while she was driving June 24, 2004, and, after searching her car, "indicated that he liked large breasts," the lawsuit states. He then asked for permission to search her, saying he could claim she was drinking and driving, the lawsuit said. During the search, he fondled her breasts and handcuffed her when she started to resist, the lawsuit states.
When Lockaby drove her to the Central Booking Facility, he told her he wouldn't report that she had been drinking if she would "forget the whole thing," the lawsuit said. The woman tried to complain to an Austin police officer at the jail, but the officer told her she could not make the complaint there, the lawsuit states.
A male jail staff member then told her "in a loud, threatening way" not to talk and pushed her into a small, locked room alone, the lawsuit said. Her attorney, Jeff Avant, said she was arrested for a warrant on an unpaid traffic ticket. The jail staff never made a report about her complaint, the lawsuit said.
Officials with the Austin Police Department and the Travis County sheriff's office, which runs central booking, said this week that they could not comment on pending litigation.
The woman didn't file a complaint with the Police Department — which learned of the incident when investigators asked her about Lockaby in November 2004 — because she was afraid no one would believe her, according to a police report based on her interview with police.
