A Fort Gibson police officer was charged Thursday in Muskogee County District Court with one count of lewd molestation.
Court records allege Kelly Scott Pierce, 39, inappropriately touched the private parts of a 3-year-old girl who was enrolled in a day care center owned by Pierce.
A probable cause affidavit filed with the case alleges the 3-year-old told her stepmother that “Pierce hurt her bottom (vagina) by placing his fingers on her bottom (vagina).”
Pierce’s lawyer, Eric Jones, said allegations against his client are false and that statements made to investigators have been inconsistent.
Jones said the Department of Human Services investigated the allegations six months ago. The agency’s findings, Jones said, were inconclusive.
“I don’t know how DHS can come up with a new conclusion when there’s been no new evidence,” Jones said. “We can’t get to court soon enough to prove these allegations false.”
Deputy Chief Lannie Edwards of the Fort Gibson Police Department said Pierce was suspended from duty with pay. The town council, Edwards said, will address Pierce’s suspension during its next meeting.
Pierce was suspended from the force earlier this year after the alleged victim’s mother obtained a temporary protective order against Pierce. Clara Carr, also known as Abby Winchester, alleged in documents filed with her petition that Pierce began stalking her after he learned she was a “complaining party against Pierce in a case involving allegations of child sexual abuse.”
Carr abandoned her efforts to make the order permanent before her petition was heard in court, and Pierce was reinstated. Carr’s attorney in that case, Chad Richardson, said the protective order petition was dismissed in part because his client did not want to impede any investigation of allegations that resulted in the lewd molestation charges being filed.
Pierce surrendered to authorities Thursday. He posted a $20,000 bond and was released.
