03/28/2006 - Robert Fields has asked the Monongalia County Civil Service Commission for a hearing on whether he should get his job back. He resigned after he was arrested in February.
The Civil Service Commission decided that it could not make a decision in the matter. Fields will have to take his case to circuit court where a judge could make the ruling if he gets his job back.
On February 21st, the Monongalia County Sheriff's Department arrested the 29-year-old on an incident stemming from more than a year ago. A female juvenile told police that Fields touched her inappropriately and held her leg down so she couldn't move. Fields resigned from the Sheriff's Department and a couple of weeks later wrote a letter to the sheriff asking for his resgination to be rescinded.
On Monday, the commission said the state statute does not give it the authority to determine if Field's resignation was handled properly.
No word on when this case will be be in circuit court, if at all.
