01.14.2007 - ALLENTOWN, Pa. -- A judge dismissed felony charges against a state trooper accused of posting nude pictures of his ex-wife on a bondage Web site. Officer Luke Heller of Lower Macungie still faces two misdemeanor charges of identity theft and harassment. Felony charges of unlawful use of a computer and criminal use of a communication facility were dismissed Monday by Lehigh County Judge Robert L. Steinberg. He ruled that the unlawful use of a computer law was intended to combat hackers. Without a supporting felony charge, the communication facility charge was also dismissed. Lehigh County Chief Deputy District Attorney Matthew Falk said he is considering an appeal. Heller, 36, a 14-year veteran of the state police, was charged in March 2006 and suspended from his job.
