August 28, 2006 - LOS ANGELES -- The former San Bernardino County Sheriff's deputy charged in connection with the shooting of an Air Force senior airman appeared Monday in court. A judge ruled that there is sufficient evidence for the case to go to trial. The trial was scheduled to begin in September. During a brief proceeding earlier this year, Judge Michael Smith agreed to push former deputy Ivory Webb's preliminary hearing into August. This gave attorneys more time to review an FBI enhanced copy of a home video considered key evidence in the case, NBC4 reported. Webb pleaded not guilty during the earlier court appearance to attempted voluntary manslaughter in the videotaped shooting of the unarmed man who had been riding in a car pursued by the deputy. The car's driver separately pleaded not guilty to felony evading and misdemeanor driving under the influence. On Jan. 29, Webb was videotaped shooting Air Force Senior Airman Elio Carrion, 21, three times. Carrion testified Monday at the hearing. "My purpose today was to show that there is sufficient evidence, that there is probable cause to hold the defendant to answer," said Deputy District Attorney Lewis Cope. The shadowy nighttime recording made by a resident showed Carrion on the ground by the passenger door of a Corvette that crashed after a pursuit in Chino, 45 miles east of Los Angeles. Carrion appeared to obey a command to "Get up" when the deputy fired. Carrion was hit in the chest, shoulder and left thigh, but survived. "Mr. Carrion exchanged profanities with my client," said defense attorney Michael Schwartz. "At times, he was challenging. It wasn't quite the picture that may have been put out in the media when the case broke." www.nbc4.tv/news/9749516/detail.html

I find it highly amusing that many of you cite "Innocent until Proven Guilty" when the police deal with you, but you fail to show the same courtesy here. It really weakens your agenda and causes people to take you less seriously.
If the deputy is found guilty, he'll pay for it. If not, then the "victim" has the right to a Civil Suite- which I'm sure he'll file anyway.

SAN BERNARDINO, CALIFORNIA - A former sheriff's deputy who was videotaped shooting an unarmed man who appears to be following his orders must stand trial on an attempted voluntary manslaughter charge, a judge has ruled.
Judge Michael A. Smith determined Monday there was enough evidence to try Ivory J. Webb after hearing four hours of testimony and watching a video that shows the former deputy shooting Elio Carrion, an Air Force senior airman who had just returned from a tour in Iraq.
The Jan. 29 shooting occurred shortly after the car Carrion was riding in crashed following a brief high-speed pursuit in Chino, 45 miles east of Los Angeles. The shadowy nighttime recording shows Carrion lying on the ground by the passenger door of the crashed Corvette. It shows Webb, 45, kicking Carrion and shouting profanities as the airman told him he was "on your side" and in the military.
Carrion appears to obey a command from Webb to "Get up," and is shot in the chest, shoulder and left thigh as he begins to rise.
Carrion, 22, testified in Monday's preliminary hearing that he drank beer and tequila shots at a barbecue earlier that day and did not remember getting into the Corvette with his friend.
When the vehicle was stopped and he got on the ground, Carrion testified he tried to explain to Webb "that it was a misunderstanding, my friend did wrong, we mean no harm." After he was ordered to get up, Carrion said, "I repeated, 'OK, I'm going to get up now.'"
During cross examination, defense attorney Michael D. Schwartz suggested Carrion did not follow order when he was told to stop talking. He suggested Carrion tried to reach into his jacket as he got up and replayed a portion of the video in which it appeared that Carrion moved one of his hands in front of his chest.
Carrion contend he did not put his hand in his jacket.
A Sheriff's sergeant testified that Webb told him that Carrion had tried to get up and lunge at him. But the man who recorded the video, Jose Luis Valdes, told the court that he never saw Carrion lunge at the deputy or make any threatening gesture.
Webb, who left the department in April, was scheduled to be arraigned Sept. 11. He faces up to 18 1/2 years in prison if convicted.

Supposedly the D.A. has allowed Deputy Ivory Webb to make court hearings via "speaker phone"...Would you or I ever get preferred treatment? Is this normal? Why is he being shielded from the public?

After reading all the dialogue, here is my two centavos worth. Cause & effect is at play. The Iraq vet and the officer had a date with destiny. Both were on the edge and willed this confrontation. Each has to answer privately and to the public with what they were thinking and doing. You can explain anything away after the fact, but it is in the moment that something takes place that you will find the most reality (truth). Anything after that is the ego explaining itself away. Watch how distorted this thing becomes. Lot’s of money to be made here as well as points. Mr. Iraqi vet…you want to drive around at night drunk and disobey laws? You will run into "braking forces" to slow you down. Some even fatal. Mr. Policeman… you think it all is decided by the golden rule, namely he who has the gold rules, then you will reap what you sew. These two had a meeting set up along time ago. Both need to get their acts together. If this is mankind at its best, no wonder why we needed a savior. Whew!

11.04.2006 - SAN BERNARDINO - A trial date for Ivory J. Webb Jr., the former sheriff's deputy charged with shooting an unarmed man after a high-speed chase, was set for Jan. 5, 2007. Webb was not in court Friday when San Bernardino County Superior Court Judge Michael A. Smith set the date. Webb is charged with attempted voluntary manslaughter and assault with a firearm in the January shooting of Air Force Senior Airman Elio Carrion. Carrion, who had just returned from a tour in Iraq, was a passenger in a Corvette that fled from deputies. After the car crashed into a wall on Francis Street in Chino, a nearby resident filmed Carrion lying face down as Webb apparently shouted at him to get up. Carrion eventually appears to tell Webb he is getting up, and as the airman pushes himself off the ground, Webb fires three shots, hitting Carrion in the chest, left shoulder and leg. Webb faces more than 18 years in prison if convicted of attempted manslaughter and up to 17 years in prison on the assault charge. www.dailybulletin.com/news/ci_4599763

My thoughts and prayers are with the family of Deputy Webb. Police Officers are called upon daily to protect and serve. Is it possible that Deputy Webb told the guy to "shut up"? My husband is also a Police Officer and I can imagine what Mrs. Webb and her entire family are going through right now. I will pray and offer my support to this family. I am sorry that the guy was shot, but lets think about it, why were they running from the police in the first place? If he is the "hero" that he wants to be hailed as, why was he driving in the car with someone who was drunk. Can we at least give this Deputy the benefit of the doubt? I wonder if charges would have been filed had he been a white Deputy. May God help us all if this man spends one moment in jail. The criminals have rights, what about Deputy Webb? My heartfelt prayers and thoughts are with his family tonight and until this Deputy is cleared of all charges. Paulette, The former Deputy Webb crossed the line when he knowingly discharged his service sidearm multiple time against an unarmed citizen and then proceeded to berate & cuss at that same unarmed citizen he had just attempted to cause significant bodily harm. There are three universal qualities among all men & women in American law enforcement they all wear a uniform, gun, & badge. Most John or Jane Q. Public don't ever see anything beyond those three items. I oppose your views of former Deputy Webb and feel that is an abomination and discredit to the honest and integrity who lawfully serve and protect with us with our consent. Mister Webb should be found guilty sentence to maximum penalty allowed by law without chance for probation nor chance or parole. Just the opinion of a former civilian LEO and disabled veteran. BTW, Azrach the only all the time appreciated heroes seem to be Firefighters. Thanks for serving.

I hope this douchebag gets his just rewards. Sad to say, but I'm sure many more cases like this exists with cops abusing their powers. The sad part is how the system hides and protects them from such actions.
Don't think we are moving to a police state? Think again.
A message to that bitch Paulette: How can you defend this sack of shit? All because your husband is a cop? If he's anything like that guy, I hope your husband gets killed while on duty. We dont' need scumbags criminals representing our community. Two of my family members are officers and I would fuckin beat their asses myself if I ever heard of them doing such shit.
