12.31.2006 - FLORENCE — A magistrate has dropped murder and other charges against a former Florence County deputy sheriff.
Deputy Timothy Poole was accused of killing his mother and her husband in Williamsburg County after ruling there is not enough evidence for the case to go forward.
Poole was released from jail after Wednesday's hearing. He had been behind bars since his arrest Nov. 22.
Sheriff Kelvin Washington disagreed with magistrate William Driggers' ruling and said his deputies plan to ask a grand jury to hand down indictments in the case.
“Our position is the same as it was from the beginning, that this case was a very strong case,” he said.
Poole was charged in the August shooting deaths of his mother Linda Bright-Poole Hilton, 60, and her husband of about three years, 64-year-old William Henry "Bubba" Hilton Jr.
The two were found dead at their Lakewood Plantation home Aug. 2, near Nesmith in Williamsburg County.
The body of Linda Hilton, who owned and operated a Pawleys Island store, was found in the yard of her residence, Washington said. Her husband’s body was found inside the house.
The Hiltons frequently attended All Saints Church in Pawleys Island where they were married three years ago.
Linda Hilton and Margaret Murphy were business partners. The women owned the Christian gift shop “As For Me and My House” in Pawleys Island.
