Jan 16, 2007 (CBS4) ROCKPORT Rockport Police Department's domestic violence officer has pleaded not guilty to assault with a dangerous weapon, domestic assault and battery, armed assault with intent to murder and discharging a firearm within 500 feet of a building. Robert O'Neil, 38, who was arraigned on Tuesday in Gloucester District Court, is now being held on bail pending a dangerousness hearing on Friday. According to court documents, O'Neil was allegedly drunk and high on prescription drugs Friday night when police say he pulled out a gun during an argument with his wife and fired a shot about six inches away from where she was sitting. She was not hit. Their two-year-old daughter was in the house during the incident. O'Neil, 38, an officer in Rockport since July 1999, was suspended with pay pending a hearing before the town's board of selectmen. The gun that was fired was not O'Neil's department issued weapon. He was held over the holiday weekend on $500,000 cash bail after being arrested in his home Friday, police said. The town's board of selectmen has asked Chief Tom McCarthy to provide them with an internal police department report of the incident.
