Officer David Marshall Runs from the Cops

12.28.2006 - FARMINGTON HILLS -- The attorney for a Detroit police sergeant who was Tasered three times by Farmington Hills police says his client did not try to flee police after a traffic violation.

Sgt. David Marshall is charged with running a red light at 10 Mile and Inkster about 1:05 a.m. Dec. 13 after getting off work from the Detroit Police Department. The 12-year veteran, who was in uniform at the time of the incident, is also charged with interfering with police authority.

Attorney Arnold Reed also said Marshall was unnecessarily stripped down to his underclothes at the police station after surrendering his police radio and ammunition.

"There is no reason my client had to go through what he did," Reed said.

Reed added the police officers didn't activate their overhead lights until Marshall pulled into his Farmington Hills driveway. While still seated in his car getting mail from his mailbox, Marshall was asked to get out of his car and remove his weapon from its holster.

Marshall requested that a superior officer be brought to the scene and his car was searched, Reed said. Officers used the Taser the first time on Marshall when he reached for his radio. He later placed his hand on his gun and the officer stunned him again. Reed said Marshall had put his hand on the weapon to secure it.

A court date has been set for 2 p.m. Jan. 8 in 47th District Court.

Farmington Hills Police Chief William Dwyer said the incident has been investigated and the use of a Taser was justified.

"I believe both officers could have been more professional towards each other; then the situation would not have escalated," Dwyer said. "But it did and it's unfortunate."

01.09.2007 - FARMINGTON HILLS -- Detroit police Sgt. David Marshall appeared in court Monday.

He’s charged with resisting arrest after a run-in with Farmington Hills police last month while he was off-duty. Police say Marshall got aggressive during a traffic stop after he allegedly ran a red light. Marshall said Farmington Hills police shocked him with a Taser gun 3 times.

Farmington Hills Police Chief William Dwyer said, “Quite frankly, I think that both officers could have been more professional. And if they would have been more professional it wouldn’t have escalated.”

Marshall faces three charges stemming from this incident: interfering with an officer, resisting arrest and running a red light. In a surprising turn Monday, prosecutors added child abuse charges to the list, claiming Marshall abused his 14-year-old son.

Marshall’s attorney Arnold Reed said the child abuse charge was brought against his client to make him back down from his accusations against the Farmington Hills Police Department. Reed - who's client is African-American - said the traffic stop was racially motivated. Dwyer denies the incident was racially motivated and said his department does not tolerate any sort of racial profiling. Marshall is expected in court later this month on the child abuse charge.

FARMINGTON HILLS, Mich. -- A 12-year Detroit police veteran charged last month with resisting arrest and running a red light has some religious support in his corner.


About 200 members of Detroit's Greater Grace Temple packed into a Farmington Hills courtroom Hills on Friday to show support for police Sgt. David Marshall, who was hit with a stun gun on Dec. 13.

Marshall, who lives in Farmington Hills, was in his uniform when he was shot with a Taser after refusing to give up his gun and later reaching for it, police told the Detroit Free Press.

Marshall's attorney, Arnold Reed, called the incident racial profiling.

"We are here today because we are tired of these kinds of actions by police," said Reed, who was with a crowd of supporters, most of whom came from Greater Grace Temple, where Marshall attends.

Farmington Hills Police Chief William Dwyer said an internal investigation cleared an unidentified 16-year Farmington Hills officer of wrongdoing.

Dwyer said he is disappointed with the officer's actions and said both men should have had more respect for each other. "If the sergeant and the officer who pulled him over would have been more professional, this would not of happened," Dwyer said.

Marshall also will face child abuse charges for allegedly hitting his wheelchair-using stepson in a May incident when he returns to court on April 25, Dwyer aid.
