09.18.2006 - VERMILION — A Lorain police lieutenant was charged with operating a vehicle while intoxicated and driving left of center Friday after Erie County Sheriff’s deputies pulled him over on Thompson Road in Vermilion, a sheriff’s report said. Officer Robert Stack III, 58, of Vermilion — one of six Lorain police lieutenants — was pulling out of the American Legion post on state Route 60 around 9 p.m. when his pickup swerved into the path of an oncoming Erie County deputy, the report said. After the deputy was forced off the side of the road to avoid the truck, he observed it travel “at a very slow rate of speed” and cause the vehicle behind it to ride its brakes, the report stated. The deputy followed the truck to Thompson Road as it went across the center line and almost off the left side of the road, the report stated. The deputy pulled the truck over and asked the driver, Stack, to perform a series of sobriety tests. After nearly falling over while trying to stand on one leg and count from 1,001 to 1,030, Stack told the deputy: “I can’t do this,” the report stated. Stack was handcuffed and taken to the Vermilion Police Department, where the deputy confiscated his driver’s license after he refused to submit to a breathalyzer test. Stack was “polite, cooperative and extremely apologetic for his actions,” the report stated, adding that he has no prior DUI convictions. 09.20.2006 - VERMILION — A Lorain police lieutenant who was charged with DUI Friday had driving privileges reinstated Tuesday after a hearing in Vermilion Municipal Court, court officials said. Robert Stack III, 58, of Vermilion, was granted driving privileges for work, effective immediately, a court official said. After showing proof of insurance and his work schedule at the hearing, the court issued Stack a driving card in place of his license, the official said. Stack was pulled over by an Erie County sheriff’s deputy near state Route 60 around 9 p.m. Friday when the deputy saw Stack’s pickup swerve after leaving an American Legion post, a sheriff’s report said. Stack has been assigned to desk duty while Lorain police conduct an internal investigation. Police Chief Cel Rivera will ultimately decide whether the lieutenant will be allowed to drive a police cruiser again, said Lorain police Capt. William Engle. Engle said Stack’s personnel file showed multiple commendations from Lorain police and other departments during his career. The only negative remarks were a handful of written reprimands for taking time off without sick or vacation time.
