A rookie police officer forced an 18-year-old girl to flash him last month in Pasadena in order to get out of a traffic ticket, county police said.
Officer Joseph Mosmiller, a 2006 graduate of the county’s police academy, was charged yesterday with fourth degree sex offense, second degree assault, false imprisonment and misconduct in office. He is confined on $250,000 bail at the Jennifer Road Detention Center.
"These allegations are extremely disappointing, and if proven factual, are unacceptable. I am , however, very pleased with the way the allegations, and subsequent investigation, were handled by the department," Chief James Teare Sr. said in a prepared statement. "I’m very proud of the men and women of the Police Department and I will continue to emphasize the significance of maintaining the trust and support of the citizens we serve."
According to charging documents, Officer Mosmiller pulled over a car Jan 20 in Riviera Beach. The teenager behind the wheel said she had just picked up her passenger at a local bar.
Police said the officer lectured the girl about the dangers of drinking and driving though and told her to follow him to her home. On the way, however, the officer detoured into the Riviera Beach Library. There, he told the two women to remain in the parking lot and not leave.
Police said the officer exited the lot and was gone for about 10 minutes. Out of fear of getting in trouble, the woman waited for the officer. Upon his return, he had her follow him to the adjacent Community United Methodist Church parking lot at 8680 Fort Smallwood Road.
Once there, Officer Mosmiller asked the woman to get out of her car and administered several field sobriety tests. He then told her that if she and her friend showed him their breasts, they would not go to jail.
The passenger refused to do it, but the driver walked to tha back of the car and lifted her shirt, police said. The officer then said that was not good enough, and groped her exposed breast as he took a picture with his camera phone, according to charging documents.
Afterwards, Officer Mosmiller said the women could leave. Instead of going home though, they went straight to the Eastern District police station and reported the incident.
County police commanders reassigned Officer Mosmiller to administrative duties after receiving the complaint. If he posts bond, he will be allowed to return to those administrative duties, police said.
Police said an internal affairs investigation is under way.
