01.03.2007 - Wright County Prosecutor Larry Tyrrell and a former Mountain Grove police officer have sued a former police chief, a former judge and two attorneys for alleged racketeering.
Tyrrell and Officer Larry D. Shepherd also made claims of civil rights violations and malicious prosecution in separate but similar lawsuits against Tommy Gaddis, Roger Wall and Cynthia and Jason MacPherson.
The complaints alleged the defendants tried to control Wright County law enforcement and courts "for their unlawful personal purposes, to protect themselves from investigation and prosecution, and to discredit and injure the lawyers and law enforcement officials who opposed them." The lawsuits were filed in the past two weeks at Springfield's federal courthouse.
Former Associate Douglas County Circuit Judge Wall denied the allegations when contacted Friday.
"I've been an honest public official all my life," he said.
Wall expected to represent himself in the cases because he lacked money for legal representation. He still faces a child pornography possession charge that he denies and wishes would be resolved.
Efforts to reach former Mountain Grove chief Gaddis and the MacPhersons for comment were unsuccessful. No responses had been filed in federal court as of Friday.
Shepherd alleged in his complaint that Gaddis falsely accused him of stealing a knife and two handheld radios from a suspect during a September 2002 felony arrest. Tyrrell had declined the case.
Jason MacPherson, Mountain Grove's city attorney, prosecuted the case until a jury acquitted Shepherd in October.
Shepherd alleged Wall filed false affidavits to show he was guilty of stealing.
Wall and his attorneys, the MacPhersons, were also accused of racketeering in efforts to remove Tyrrell from office.
According to Tyrrell's complaint, Wall filed a civil defamation lawsuit in November 2004 against Tyrrell and others who filed complaints against Wall with the judicial commission. Wall's lawsuit was later dismissed.
The MacPhersons filed affidavits in November 2004 accusing Tyrrell of various misconduct, but the Missouri attorney general's office declined to take action against Tyrrell, the complaint said.
Tyrrell and Shepherd, who now resides in Louisiana, are represented by St. Louis attorneys Erica Leisenring and Mark Mittleman.
