Hello my name is ______ and I was the victim of a great injustice on the evening of 1/27/05. I was beaten, verbally abused and threatened with torture by the Chicago Police Department, in particular Officer Alvarez of the 24th District.
My now x-girlfriend Troy Anise McMillan made several threats to me during the months of December and January, she said she could have someone come into our apartment and kill me and get rid of my body and my parents would spend years trying to figure out what happened to me. She told me that she could get her cousin Jeffrey “Bugs” Smith ( Al Piemonte Ford Salesman, Chicago) to follow threw on her promise. Well on the evening of 1/27/05 she almost made good on her promise as you will read in my statement of events for the evening of 1/27/05.
This dangerous individual Troy Anise McMillan escaped justice on 1/27/05, it was obvious that she had some pre-existing relationship with Officer Alvarez of the 24th district. Troy Anise McMillan pulled a gun on me that evening and also brought a 6’3 African American Male into our apartment that evening to intimidate me. She claimed the man was her half sisters ( Robin) cousin Henry after I called the police. This women made two attempts to kill me that evening and I would like to know why Officer Alvarez covered up her actions?
My landlord told me that our neighbor saw Officer Alvarez return to my former residence (Chicago, IL 60660) and could hear Troy and the Officer engaging in sexual activities, while I was being interrogated for the gun she attempted to shoot me with. Jeremy also told my landlord that the Officer Alvarez was at my former apartment several times the following weekend. Jeremy was in the apartment with me when I called 911 the second time that evening as you will read in my statement.
Troy has a friend at work Laura Crivlare-Maglio who is married to a Chicago Police Officer and her supervisor Michael Alvarez shares the same last name as the arresting officer, perhaps a relative? Troy told me she could get me out of the apartment and keep all of my things, and, well she has succeeded with the help of some corrupt officers and possibly some co-workers.
I would like to add that bogus charges that were brought against me were dropped by the prosecutor on 4/22/05. Troy was present in court and I am sure the prosecutor caught her in several lies, that is why he chose not to use her testimony.
My attorney James advised me to wait until my court case was adjudicated before pursuing these corrupt officers and Troy Anise McMillan. They were afraid that the officer Alvarez may add false statements to the police report. The bogus charges against me were dropped on 4/22/05, now I would like justice. I filed a complaint on 4/22/05 with the Office of Professional Standards Chicago, they have accepted my case, yet the investigation is moving at a snails pace.
It took this Officer Alvarez minutes to destroy my life, I will never call 911 for assistance again. Several weeks have passed since I filed my complaint and I have heard little from the OPS, the illegal actions of this officer has cost me thousands of dollar’s and taken a great toll on me and my family emotionally. I know longer believe in the criminal justice system, what kind of world do we live in where a man call’s the Police for help, and they beat him, torture him and falsely arrest him, and denied me my Miranda rights. I was not allowed to make a phone call until 4hrs after I was falsely arrested, are these Chicago Police Officers above the law?
Statement Of Events
1/27/05
Thursday, 1/27/05 around 9:30pm I was sitting on the back porch of my apartment that I share with Troy A McMillan (address above). Troy (my bipolar manic depressive girlfriend) came to the back porch and said very sarcastically "I have someone I want you to meet". I turned to look and was surprised to see a 6'4 African American male standing in my doorway wearing black leather gloves, he looked at me and said "it's time". I reached into my tool bag sitting next to me grabbed my cell phone and immediately dialed 911, I knew this man was there to do physical harm to me. I told the 911 dispatcher my girlfriend had made several threats to me in the past and how she could have someone come into our apartment kill me and get rid of me and that my parents would spend years trying to figure out what happened to me. After I hung up with the 911 dispatcher she laughed, put her arm around his waist and told me that I was so stupid, stupid, stupid and that the police were going to come and not do anything to her or her friend. I walked over to the door she grabbed my arm and I dialed 911 again and told the dispatcher the man was still there and I was wondering where the police were. He would not move from the doorway, he kept clinching his fist, then I managed to open the back door and yell down the back stairwell for my neighbor Jeremy K Smith, he came running up the back stairs, and stood there and waited with me for the police to arrive.
After 10 minutes or so 5 or 6 officers arrived at my apartment led by Officer Alvarez 24th precinct , I began telling them what the situation was, officer Alvarez and the other officers acted as if they were not interested in anything I had to say. Alvarez immediately talked to Troy on the back porch at which time she handed him a glass water bong that she had purchased, I was then ordered into the living room. The officer Alvarez, Troy and some other officers went into our bedroom (while I was told to stay in the living room). They began searching the bedroom for drugs and drug paraphernalia, the entire time I was telling them I called for help this women had made several threats to me in the past month, this man was in this house to do something to me, he had 2 other men waiting in his white Ford Taurus with temporary plates in front of my house. There was a heavy set officer standing by my front door chatting with this intruder who was now sitting at my dining room table enjoying a cigarette. The officer and this man were making jokes about me being a nut case and the officer kept saying "yeah we know you just came by to say hi to Troy, and those guys in your car are just your tenants". I have lived with this women on and off for 9 years and never saw that man before in my life. It is about this time that an officer came from the bedroom with an empty cellophane bag and began calling me a crack head (I do not use cocaine) and then Alvarez came from the bedroom and said he found a box of 25 caliber bullets and said to me "where is your ****ing gun you ****ing low life scumbag". Alvarez ordered and officer to "search that piece of ****" meaning me. He frisked me, I asked him why was he frisking me, I called for their help, the officer told me to "shut the **** up". Then the officers began to search the house looking for a gun. At no time did they search Troy or her friend. Troy and the officer Alvarez were in the bedroom together while the other officers were searching our apartment for a gun.
Alvarez came to the doorway in the bedroom and told me to "get the **** in there". When I walked into the bedroom I noticed my things had been torn apart, he then ordered me stand in front of the closet and told me" I was a low piece of **** nothing, that I needed to get some ****ing help". I glanced down to get his badge number that is when I noticed his name was Alvarez at that time he noticed and said "you mother ****er you are trying to get my name and badge number I should hall your ass for drug paraphernalia". Troy was standing behind officer Alvarez grinning at me the whole time. Troy, Alvarez and myself walked back into the dining where the other officers and this African American male were all telling jokes about me. Alvarez told me "I should get dressed and take a walk around the block", then he looked at Troy and said "if you find that piece of ****s ****ing gun call me and I will haul his loser ass to jail tonight". All the officers, Troy and the African American male left together.
I got dressed ran around the house trying to pack up a few things about 30 minutes passed and Troy came back into the house alone. We began arguing, she walked into the bathroom and it looked as if she had something under her blouse. She then walked into the bedroom, I followed her a minute or two later into the bedroom. She was sitting on the side of the bed with her cell phone in her hand dialing a number I said "who the **** are you calling" She screamed "alright you mother ****er you are going to die" she flipped the pillow up there was a black gun which she grabbed (I never say any guns before this nor do I have any guns nor have I ever) starting to point it up toward me and I ran out of the bedroom screaming "help, help, help" down the hallway and ran into the front bedroom, shut the door, pushed the dresser in front of the door, she had already reached the door and had it ajar slightly, I flipped my cell phone open dialed 911, she noticed the light from my cell phone illuminating the bedroom and said "if you don't hang up that phone I am going to start shooting". I hung up the phone and began praying and pleading for my life. My cell phone rang Troy asked who it was, I lied and told her it was my parents I was afraid to tell her it was a number I did not recognize perhaps it was the police. I heard Troy run down the hallway and I looked out the front window of the bedroom and noticed a police car had pulled up. When I heard the officers coming up the stairs I came out of the bedroom. Troy came from what appeared to be the bathroom and was standing next to the dining room table when the two officers came into the apartment. These 2 officers were not at the house the first time. I was shaking and crying, I told them that she had pulled a gun on me and was trying to kill me. The officers immediately asked her where did you put the gun. She was very calm and said to them "he's crazy there's no gun in here, we do not own a gun, I do not own a gun, you guys need to call Alvarez he knows what's going on here". They radioed Alvarez who was there with a female officer who was there the first time in less than 2 minutes. He walked into the apartment, huffing and puffing, and looked at me and said "you mother ****er what did you ****ing do". He looked at Troy and said "Troy come on lets go into the bedroom", I tried to follow but was ordered to stay in the living room. I was still shaking and crying when Alvarez came from the bedroom huffing and puffing with what I would describe as a psychotic look in his eyes. He charged at me calling me names, he back handed me across my stomach pulled me into the bedroom where a few minutes before I was begging for my life. He slammed the door threw me into a corner I bounced out of the corner he back handed me across the top of my chest and then again across my stomach twice, he was screaming at me "did she really pull a gun on you, you low life mother ****er" I was crying and on my hands and knees asking him why he was doing this to me, I called the police for help, why aren't you helping me. He grabbed me by the back of my arm again dragged me back into the living room and ordered me stay there. He said Troy come on he walked into the bathroom she followed him then he came from the bathroom yelling "I got you, you low life mother ****er" "I have your ****ing gun" Troy was behind him very calm and grinning at me. Alvarez came at me in the living room, and said "you mother ****er your under arrest" grabbed my right wrist twisted it up very high behind my back at which point I began to scream out in pain. The female officer came running up to him and said "this is out of control, you are out of control". The handcuffs were very painful. He dragged me to the front door at which time the same female officer said "it's freezing outside he needs his coat, he needs his id" Alvarez said "he doesn't need a ****ing thing" as he was about to throw me down the stairs leading to the vestibule the blond officer came running up behind him and said "I got his coat". I know in my heart if she had not have come up behind him he would have thrown me down those stairs. The whole time I'm telling him that Troy is a bi-polar, manic depressive who does not take her lithium or paxil, what about my rights don't I have any rights. He told me to "shut my low life ass up and that I don't have any rights" then he literally threw me in the back of the squad car nearly breaking my arm. I kept telling him in the car I called you for help, he told me "I better shut the **** up or else"
When we got to the 24th precinct Alvarez dragged me threw the precinct verbally abusing me. I was crying and just kept asking "why, why, why". He literally threw me in a corner interrogation room, unhand cuffed me, handcuffed my left arm to the pole behind me. Then the 2 officers who arrived the second time at our apartment sat down. Alvarez told them "not to believe a ****ing word I say" " he is a ****ing scumbag liar". At this time I asked the officer what the hell was going on and he said "Troy said you pulled the gun on her then she took the gun from you pointed at you and when we arrived she threw it in the trash can in the bathroom". I said no, no, no and at this time his partner who had a Russian accent and Russian sounding last name grabbed my right arm and stretched it out and hand cuffed it to the other end of the pole. I tried to tell him that it was very painful and I had lung surgery on my right side of my chest, the Russian sounding officer told me "if I did not shut the **** up he would mace my ass and lock me in that room for 20 minutes by myself. The gun which the officers told me was a 38caliber was sitting on the desk in front of me. Officers were coming in and out of the room picking up the gun pointing it at me and laughing. The Russian sounding officer kept saying to me "why don't you just kill yourself, your nothing, your a low life, just take the gun and shoot yourself". The officer behind the typewriter and the Russian officer were asking me "where I got the gun, why did a pull a gun on Troy..etc..etc." I want to add that the Russian sounding officer kept saying "lets play Russian roulette", and "ok I am going to remove my badge and heat up the pin under my badge and stick it under your fingernails, I bet you will talk then" and he told me "I will put one round into the chamber let you go in the parking lot if I shoot and I miss you are free to go". All this went on for what seemed to be a long time. Alvarez came back in street clothes, I heard an officer say there is nothing on his record. Alvarez was suddenly polite, he said "Matthew answer all there questions and you will be out of here ASAP" they uncuffed me. During all this the blond female officer would not make eye contact with me, she seemed antsy and nervous, she kept walking in and out of the room. I heard someone out in the hallway say "railroaded and Alvarez" The officer behind the typewriter looked up and said "we really should have brought her in". These same officers began giving me advice like "just bring your friends to court and say it is not your gun, this may not end up on your record". Eventually I released on an I bond at 9am the following morning and I had walk for 35 minutes to my apartment in the freezing cold with no scarf, gloves, hat or socks. I immediately left the apartment with the clothes on my back.
